These are some other guidelines from the Federal Motor Carrier Safety Administration (FMCSA) for how random drug testing should be administered:

  • All CDL drivers must have an equal chance of being tested.
  • The alcohol tests must be administered just before, during, or immediately after a CDL driver has performed a safety-sensitive function.
  • Each employer shall ensure that random alcohol and controlled substances tests conducted are unannounced.
  • Each employer shall ensure that the dates for administering random alcohol and controlled substances tests conducted are spread reasonably throughout the calendar year.
  • Non-CDL drivers can not be included in the DOT random testing pool.

Code of Federal Regulations 49 CFR 382.305 goes over the acceptable methods of random selection:

“The selection of drivers for random alcohol and controlled substances testing shall be made by a scientifically valid method, such as a random number table or a computer-based random number generator that is matched with drivers’ Social Security numbers, payroll identification numbers, or other comparable identifying numbers.”

What Are the FMCSA Random Drug Testing Rates for CDL Drivers?

The current 2023 required rates for random drug and alcohol testing are as follows:

  • 50% of your CDL drivers will be tested for drugs each year.
  • 10% of your CDL drivers will be tested for alcohol each year.
