Pre-Employment Drug Testing

Before operating a commercial motor vehicle (CMV) for the first time, a truck driver or other CDL driver must undergo a drug test and receive a negative test result. Employers & owner/operators must ensure that this test is conducted.

Random Drug and Alcohol Testing

Owner/operators must participate in a DOT-approved random drug and alcohol testing program. The testing rate for random drug testing is 50% per year, while the testing rate for random alcohol testing is 10% per year. Employers have the option of joining or creating their own pool.

Post-accident Drug and Alcohol Testing

If a CDL driver is involved in an accident that meets certain criteria–fatalities, injuries requiring immediate medical attention, or towing of any vehicle–that driver may be required to undergo drug and alcohol testing.

Reasonable Suspicion Drug and Alcohol Testing

If you have reasonable suspicion to believe that a driver is using drugs or alcohol while on duty, the driver may be required to undergo drug and alcohol testing.

Return-to-Duty Drug and Alcohol Testing

If a driver has violated the DOT drug and alcohol testing regulations, he or she must undergo a return-to-duty drug and/or alcohol test before returning to safety-sensitive duties.

Follow-up Drug and Alcohol Testing

If a driver has violated the DOT drug and alcohol testing regulations, he or she may be subject to follow-up testing for up to five years.

What is a Safety Sensitive Employee?

Part of the DOT’s drug testing program involves those employees that require testing. Specifically, all “safety-sensitive” employees require drug testing under these regulations. According to the DOT, a safety-sensitive employee is any worker that:

  • Drives commercial motor vehicles like trucks, buses, and specific heavy equipment, or;
  • Whose job performance can impact the safety of others

In general, any of the following could be considered a “safety-sensitive” employee, and as a result, are subject to the DOT’s drug testing regulations:

  • Truck drivers
  • Bus drivers
  • Airline pilots
  • Air traffic controllers
  • Train engineers
  • Railroad conductors
  • Ship captains and crew
  • Construction equipment operators
  • Pipeline operators
  • Emergency vehicle drivers
  • Mass transit operators (subway, tram, light rail, etc.)

DOT Drug Testing Requirements For Colorado Employees

In Colorado, complying with the federally regulated DOT drug testing program is a requirement to remain licensed. As it relates specifically to the program, testing is done under the following conditions for these employees:

  • Pre-employment testing – Before being hired for a safety-sensitive job, employees must undergo a drug and alcohol test. If the results are positive, they may not be hired.
  • Random testing – Safety-sensitive employees are subject to random drug and alcohol testing according to DOT regulations. Employers can use a system that randomly picks employees for testing. They have to do drug testing on at least half of the employees and alcohol testing on at least 10% of them within a one-year period.
  • Reasonable suspicion testing – If there is a reasonable belief or suspicion that an employee is under the influence of drugs or alcohol, they must undergo testing as mandated by DOT regulations.
  • Post-accident testing – In cases where a work-related accident or incident results in a fatality, serious injury, or property damage, the employee involved must undergo drug and alcohol testing.
  • Return-to-duty testing – After a positive drug or alcohol test result, the employee must complete a substance abuse treatment program and pass a “return-to-duty” test before being allowed to resume safety-sensitive duties.
  • Follow-up testing – Employees who tested positive for drugs or alcohol and have returned to their safety-sensitive duties must undergo follow-up testing as required.

The DOT mandates drug testing using urine samples, which screen for five types of drugs: marijuana (THC), cocaine, amphetamines, opiates, and Phencyclidine (PCP). These tests must be conducted at certified facilities, which can be found throughout Colorado.
